REPUDIATION OF CONTRACTS IN CANADIAN LAW

Abstract

Using Canadian case law to study the law relating to repudiation of contracts, this article attempts to illustrate those places where development has taken place in Canada, and those where recourse to the English law is necessary. It includes a discussion of the scope of and nature repudiation, the distinction between repudiation and fundamental breach, the consequences of repudiation, the differences in termination resulting from repudiation, mutual rescission or abandonment, and remedies based on repudiation.
