Abstract

In this article the author examines Canada’s system of judicial review. In a brief description of the Canadian court system, as well as the system of judicial control, the author points out features that are similar to the system of the United States. Through a discussion of the special procedures used in litigating constitutional issues, namely the procedures used in regular lawsuits and reference cases, the author then discusses additional features of the Canadian system of judicial review. He concludes with a discussion of Canada’s procedures in relation to parties to constitutional issues.
