Abstract

This article discusses the circumstances surrounding actions made by and against trade unions within Ontario. Particularly, the author examines the difference between circumstances in which a trade union can only be sued in a representative action, and the circumstances in which a trade union may sue or be sued in its own name. Through a discussion of relevant Ontario statutes and several of the leading cases, the author comments on the inter-relationships between court decisions, as well as their possible trends, but points out that his interpretation has yet to be established as right or wrong.
