A NEW CONCEPT OF THE RULE OF LAW

Abstract

In 1959 the International Congress of Jurists gathered and developed a new concept of the Rule of Law. In this article the author describes that concept and in doing so discusses the principles underlying its development. In particular he compares the new concept with Dicey’s Rule of Law, focussing specifically on principles of individual freedom, justice and most importantly, the dignity of man. Most notable is the author’s discussion of Congress’s conclusions relating to the executive and the Rule of Law, as well as the legislative and the Rule of Law. The author concludes by suggesting that there is no greater opportunity for progress towards world peace than that offered by this new concept.
