Abstract

In this article the author discusses Canada’s current constitutional organization, as well as its development throughout the past one hundred years. In doing so he examines the dissolution of Canada’s political, legislative, and judicial bonds with the British Parliament. He then examines Canada’s internal distribution of legislative jurisdiction between Parliament and the provincial legislatures by discussing issues that have come before the courts such as free speech, as well as religious profession and propagation. The author then briefly inquires into whether or not Canada’s modern democracy and sustained order will eventually clash with the free will of man and concludes that the answer to such an inquiry can only be revealed by the future.
