EVIDENCE: A FRESH APPROACH THE AMERICAN UNIFORM RULES OF EVIDENCE (1953)

Abstract

The American Uniform Rules of Evidence codifies that country’s evidence rules in what many feel is a praiseworthy manner. This article reviews various provisions of the code to illustrate how it clarifies and simplifies many difficult common law concepts. The author urges the Canadian legal profession to scrutinize it and, ideally, use it as a template for a similar code. The reasons that the Canadian rules of evidence are in urgent need of reform and that Canadians should look to the American legal profession for guidance are discussed, as are the reasons that the Uniform Rules are relevant in Canada. Finally, a selection of the rules are analysed according to this agenda.
