PROPOSAL FOR THE ALLEVIATION OF THE EFFECTS OF FOREIGN EXPROPRIATORY DECREES UPON INTERNATIONAL INVESTMENTS

Abstract

Political instability, expropriation and nationalization are large impediments to international investment. This brief article reviews attempts by various countries to address the risk to foreign investors and surveys proposals for just compensation for expropriation. The author suggests that possibly the best way to ensure responsibility in foreign development and security for private investment is the establishment of a new international court for the handling of expropriation measures and other trade disputes.
