Abstract

To prevent the Crown from fettering its executive freedom, public policy requires certain terms in the relationship with its servants to be implied to the benefit of the Crown. Nevertheless, the Crown servant bears certain employment rights such as those pertaining to dismissal, salary, pension or annual leave, to name a few. Ivor L.M. Richardson considers the rights of the Crown servant through the public policy lens of executive expediency, and considers its effect on such incidents as dismissal, suspension, transfer, leave, arrears of salary and pension rights.
