Abstract

Codification of laws is a thankless task taken up by those whose virtues are seldom mentioned but whose lapses and deficiencies are universally condemned. Yet, having accepted the principle of codification and having enacted a criminal code, there is a corresponding need for those whose business it is to say what is to be said in the interests of accused persons. Joseph Sedgwick is one of them. The author’s affinity for those unfortunate souls accused, justly or unjustly, of a criminal offence and his efforts to retain protections reasonably afforded to them has often set him apart from his colleagues on the Royal Commission. Although he criticises the new code for making the prosecution’s job a little easier in some respects, he concludes that, considered as a whole, its existence is well-worth the attendant labour because it will make for more efficient administration of Canada’s criminal law.
