Abstract

This article is intended to assist the ordinary Canadian legal practitioner with problems he or she might face in practice, by offering a point of departure for the necessary, more detailed analysis that must occur. It is divided into three categories: international carriage under the Convention for the unification of certain rules relating to carriage by air, internal carriage and carriage between countries that is not international. The author approaches this discussion by asking whether a contract for carriage was made, and illustrating how the contract will determine the category of carriage. From there the governing law can be determined.
