Abstract

The author examines the reasons for which the Dominion may enact war legislation and Parliament’s ability to delegate its legislative war power to the Dominion, arguing that sufficient flexibility must be allowed to achieve the proper balance of power. The article canvasses complications created by the Privy Council’s restrictive interpretation of the Dominion war powers and the broadening of provincial power under the enumerated heads.
