JUDICIAL CONTROL OF UNION DISCIPLINE THE KUZYCH CASE

Abstract

By the time Kuzych v. White reached the Privy Council, the range of issues discussed in the lower courts was broad, and many of those issues remained unresolved when the highest court focused its attention on the effect of a privative clause in the union’s constitution, which prevented it from having to consider the validity of the employee’s expulsion. This article focuses on the Court’s reasoning and questions whether the superior courts should, in this situation, extend or curtail their control over the activities of other tribunals.
