MORTMAIN IN CANADA AND THE UNITED STATES: A COMPARATIVE STUDY

Abstract

The main concern of early mortmain laws was with the restriction on religious and charitable institutions and uses and the right to make dispositions to them. These restrictions made their way into Canadian laws. The American position is used to highlight the North American trend of moving away from the old English concepts by extending the restrictions both to non-religious charities and personal property.
