IDENTIFICATION AS A FACET OF CRIMINAL LAW

Abstract

Given the high incidence of mistaken identity resulting in convictions, the author advocates a more searching and candid inquiry at every stage of an investigation. After reviewing a number of cases resulting in wrongful conviction, the author attempts to explain how mistaken identity occurs and urges the use of the standard of establishing identification beyond alternate conclusion.
