CLASSIFICATION IN PRIVATE INTERNATIONAL LAW

Abstract

A conflict of laws question exists where different principles are competing for definition and solution of the legal question raised by a situation which has factual connection with two or more countries, and a choice must be made between them by criteria found in the private international law. Although most agree that classification is the first step in solving the problem, there is little agreement as to what is being classified. The author argues that classification can be divided into two processes: classification of facts and classification of rules of law.
